1. Agreement to Terms

By accessing or using the CLAWSER platform ("Service"), operated by WorkASharq ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

CLAWSER is an AI-powered platform that provides teams of AI agents for business and personal use. The Service includes an agent marketplace, custom agent builder, workflow packages, and related tools.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activity under your account

You must be at least 18 years old to create an account.

4. AI-Generated Content

The Service uses artificial intelligence to generate content, recommendations, and outputs. You acknowledge that:

• AI outputs may not always be accurate, complete, or up-to-date
• You are responsible for reviewing and verifying all AI-generated content before use
• AI agents act as assistants and do not replace professional advice (legal, medical, financial, etc.)
• We do not guarantee specific results or outcomes from AI agent interactions

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Generate harmful, misleading, or illegal content
• Attempt to reverse-engineer, decompile, or extract AI model weights
• Overwhelm the Service with automated requests beyond normal usage
• Impersonate others or misrepresent your affiliation
• Interfere with the operation or security of the Service

We reserve the right to suspend or terminate accounts that violate these terms.

6. Payments and Credits

CLAWSER operates on a credit-based pricing model. By subscribing to a plan or purchasing credits, you agree to the following:

• All prices are displayed in the currency indicated at checkout
• Credits are non-transferable between accounts
• Unused credits from monthly plans do not roll over unless stated otherwise
• You authorize recurring charges for subscription plans until cancelled

7. Cancellation and Refunds

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of the current billing period
• No prorated refunds are issued for partial billing periods
• Purchased credit packs are non-refundable once used
• If you believe a charge was made in error, contact us within 14 days at support@clawser.com

8. Intellectual Property

The CLAWSER platform, including its design, code, AI models, and branding, is owned by WorkASharq. You retain ownership of the content you create using the Service. By using the Service, you grant us a limited license to process your content solely to provide the Service.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described therein. You are responsible for ensuring that any data you input complies with applicable data protection laws.

10. Third-Party Services

The Service may integrate with third-party tools and APIs. We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party integrations is subject to those providers' terms.

11. Limitation of Liability

To the maximum extent permitted by law, CLAWSER and WorkASharq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Indemnification

You agree to indemnify and hold harmless CLAWSER, WorkASharq, and their officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, upon reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and indemnification survive termination.

15. Governing Law

These Terms are governed by applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
